Testimony Concludes in Lyman Murder Trial

Testimony wrapped up today in the murder trial of June Lyman. A jury will decide if she planned to kill her husband Leo or if she was suffering from post-traumatic stress, so severe, she couldn't control her actions. 

KMEG 14's Denise Hnytka reports.

A forensic psychiatrist says June Lyman is a non-violent woman, who became overwhelmed by her stresses. He said she's not trying to fake mental illness, but instead tries for years to pretend nothing was wrong. Ultimately, he says, it leads to tragedy.

The defense called their last witness Tuesday morning, a forensic psychiatrist.

"At the time this tragedy unfolded, I believe June Lyman was on tragic autopilot," explained Dr. Harold Bursztajn. 

He said he used a "Three S formula" to decide that June did not have control of her actions the night of the shooting.

The first "S" is state of mind. He said June was grieving her daughter's suicide and having trouble in her marriage.

"Leo took advantage of her," Burszatjn said. "To control her, scare her, humiliate her."

Substances are the second "S". June was taking two anti-depressants mixed with heart medication and alcohol.

"What we have is higher levels of dis-inhibiting substances circulating in the blood stream," said Burszatjn. 
     
The third is "Setting", a main room of the Lyman home.

Defense: "If a six foot five man was approaching her with his arms waving, would he have been able to get her?"

Dr. Burszatjn: "Absolutely, she would have had no place to run."

At that moment, he said the combination of state of mind, substances and setting threw her into a delirious state.

"She froze and fired."

The prosecution doesn't buy the theory. 

Prosecutor: "So those drug effects made her homicidal?"

Dr. Burszajtn: "No. That would be oversimplifying it."

The jury will hear closing arguments before they begin deliberations Wednesday morning.
